Rent Smart Wales: Everything Landlords Need to Know About Registration

If you own and rent out a residential property in Wales, you are legally required to be registered with Rent Smart Wales. This isn't optional — it's a statutory requirement under the Housing (Wales) Act 2014, and failing to register can have serious consequences for your ability to let your property and recover possession.

Here's everything you need to know.

What is Rent Smart Wales?

Rent Smart Wales is the national licensing authority for private sector landlords and letting agents in Wales. It was established under the Housing (Wales) Act 2014 and has been operating since November 2015.

Its two main functions are:

  1. Registering landlords who own residential properties in Wales
  2. Licensing landlords who self-manage their properties, and letting agents who manage properties on behalf of landlords

Who needs to register?

You must register with Rent Smart Wales if you are a landlord of a privately rented dwelling in Wales. This applies to:

  • Individual private landlords
  • Joint landlords (each person must register individually)
  • Companies that own rental properties in Wales
  • Overseas landlords who own properties in Wales

You do not need to register if the property is:

  • Your own home (owner-occupied)
  • Let to a family member under certain conditions
  • A holiday let

Registration vs licensing: what's the difference?

These are two separate requirements and it's important not to confuse them.

Registration applies to all landlords. You register yourself and your Welsh rental properties on the Rent Smart Wales database. This is relatively straightforward and involves providing your contact details and details of your properties.

Licensing applies to landlords who carry out "landlord activities" themselves — that is, landlords who self-manage their properties rather than using a letting agent. If you:

  • Find tenants yourself
  • Draw up tenancy agreements
  • Carry out property inspections
  • Handle deposits or collect rent directly

...you are carrying out landlord activities and need a landlord licence in addition to registration. To get a licence, you must complete approved training.

If you use a licensed letting agent to manage your property, you only need to be registered — the agent's licence covers the management activities.

How to register with Rent Smart Wales

Registration is done online at rentsmart.gov.wales. The process involves:

  1. Creating an account on the Rent Smart Wales portal
  2. Providing your personal details (or company details if applicable)
  3. Listing the Welsh properties you rent out
  4. Paying the registration fee

Registration fee (as of 2024): £45 online or £80 paper application. Fees are subject to change — always check the current fees on the Rent Smart Wales website.

Registration is valid for 5 years, after which it must be renewed. You should receive a reminder before your registration expires.

Your Rent Smart Wales registration number

Once registered, you will receive a unique Rent Smart Wales registration number. This is important for two reasons:

  1. You need it to apply for a landlord licence (if applicable)
  2. It must be included in your occupation contract (tenancy agreement)

Under the Renting Homes (Wales) Act 2016, your Rent Smart Wales registration number is a required term of any Standard Occupation Contract. If you fail to include it, your contract may be incomplete or unenforceable.

What happens if you don't register?

Failing to register with Rent Smart Wales is a criminal offence under the Housing (Wales) Act 2014. The penalties include:

  • A fine of up to £2,500 for a first offence
  • Potential impact on your ability to serve possession notices

On the last point: Welsh courts can take non-compliance with Rent Smart Wales requirements into account when considering possession proceedings. An unregistered landlord may find it harder to recover their property through the courts.

Additionally, local authorities have powers to serve "restriction orders" that prevent an unregistered landlord from receiving rent.

Rent Smart Wales and the Standard Occupation Contract

Since the Renting Homes (Wales) Act 2016 came into force on 1 December 2022, the Standard Occupation Contract has replaced the AST as the default residential tenancy agreement in Wales. Your Rent Smart Wales registration is directly connected to your occupation contract because:

  1. Your registration number is a required field in the written statement of the contract
  2. Having a valid, current registration demonstrates to your contract-holder (tenant) that you are operating lawfully
  3. Local housing authorities can cross-reference occupation contracts with the Rent Smart Wales register
